Terms of Service

These Terms of Service (the “Terms”) are an agreement between you and LawnSpotter (“LawnSpotter,” “we,” “us,” or “our”), based in New York, NY. By visiting lawnspotter.com, starting a free trial, creating an account, or using app.lawnspotter.com or any LawnSpotter software (together, the “Service”), you agree to these Terms. If you are using the Service on behalf of a business, you confirm that you have authority to bind that business, and “you” refers to the business. You must be at least 18 years old to use the Service.
What the Service is
LawnSpotter is web-based software for lawn care and outdoor service businesses. It gathers publicly available property records in the metro areas you subscribe to, such as home sales, new construction and other permits, code-enforcement cases, and rental and ownership records, organizes them into leads, and lets you filter those leads, build routes, and send routes to your team by email. The Service is available in English and Spanish. We may add, change, or remove features at any time.
Your account
Provide accurate and complete information when you sign up and keep it up to date.
Keep your login credentials confidential. You are responsible for all activity under your account, including activity by team members you add or share routes with.
One account is intended for one business. You may add team members from your business to your account.
Tell us right away at support@lawnspotter.com if you believe your account has been accessed without permission.
Free trial, pricing, and billing
Free trial. You can start a 14-day free trial from our website. A payment method is required to start it, and you will not be charged during the trial. If you do not cancel before the trial ends, your subscription begins and your payment method is charged. The trial includes the full Service for the plan you choose and up to 10 users. If you keep the Solo plan after the trial, it includes one user. Solo and Team memberships purchased directly, without a trial, are billed starting on the day you subscribe.
Pricing. The Solo plan costs $49 per month for each market (metro area) you select and includes one user. The Team plan costs a flat $99 per month, includes every market we cover, and includes up to 10 users. Solo totals are the number of markets multiplied by $49, plus any applicable taxes.
Automatic renewal. Subscriptions renew automatically each month and your payment method on file is charged at the start of each billing period until you cancel.
Payments. Payments are processed by Stripe. By subscribing, you agree to Stripe’s terms and authorize us to charge your payment method for all amounts due.
Price changes. We may change our prices. We will give you at least 30 days’ notice by email before a price change takes effect for your subscription.
Failed payments. If a payment fails, we may suspend your access until the balance is paid.
Cancellation and refunds
You can cancel at any time from your account settings or by emailing support@lawnspotter.com. Cancellation takes effect at the end of your current billing period, and you keep access until then. Fees already paid are not refunded, and we do not prorate partial months. To avoid being charged, cancel before your free trial ends.
Acceptable use
You may use the Service only to market your own lawn care, landscaping, and related outdoor services. You agree that you will:
Follow all laws that apply to your marketing, including local door-to-door solicitation and permit rules, “No Soliciting” signs and do-not-knock registries, telephone and text-messaging laws such as the TCPA, email laws such as CAN-SPAM, and fair housing laws.
Treat homeowners and residents with respect. Do not harass, threaten, deceive, or discriminate against anyone.
Not resell, license, publish, or share information from the Service with anyone outside your business, or use it to build a competing product or database. You may give it to service providers that work for you, such as a printing or mailing service or your customer management software (for example, a Jobber client import), only to market your own services.
Not use the Service, or any information from it, to decide anyone’s eligibility for credit, insurance, employment, housing, or any other purpose covered by the Fair Credit Reporting Act. LawnSpotter is not a consumer reporting agency.
Not scrape, copy, reverse engineer, or interfere with the Service, share your login, or try to get around usage limits or security features.
Not use the Service for anything unlawful.
You are solely responsible for how you and your team use the information in the Service and for obtaining any permits or licenses your marketing requires.
Data accuracy and coverage
The information in the Service comes from public records and other third-party sources. Those sources can be incomplete, delayed, or contain errors, and we do not verify each record. Coverage varies by market and may change as public sources change. We do not guarantee that any lead will be accurate, current, or result in business for you.
Your content
You keep ownership of the information you enter into the Service, such as team member email addresses, notes, and filters. You give us permission to store and process that information in order to provide and improve the Service.
Our intellectual property
LawnSpotter owns the Service, including its software, design, data compilations, and trademarks. We grant you a limited, non-exclusive, non-transferable right to use the Service for your business while your subscription is active and you comply with these Terms. If you send us feedback or suggestions, we may use them without any obligation to you.
Third-party services
The Service relies on third-party services, including Stripe for payments and email providers for delivering routes. We are not responsible for third-party services, and their own terms apply to your use of them.
Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT IT WILL PRODUCE ANY PARTICULAR NUMBER OF LEADS, CUSTOMERS, OR REVENUE.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LAWNSPOTTER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
Indemnification
You agree to defend, indemnify, and hold harmless LawnSpotter and its owners, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your marketing activities, or your violation of these Terms or any law.
Suspension and termination
We may suspend or terminate your access if you violate these Terms, misuse the Service, or fail to pay. You may stop using the Service and cancel at any time. Sections of these Terms that by their nature should survive, including payment obligations, acceptable use, intellectual property, disclaimers, limitation of liability, indemnification, and governing law, will survive termination.
Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Before filing a claim, you agree to contact us at support@lawnspotter.com and try in good faith to resolve the dispute informally for 30 days. Any dispute that is not resolved will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to their jurisdiction.
Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms here and change the “Last updated” date, and we will notify account holders by email of significant changes. Continued use of the Service after changes take effect means you accept the updated Terms.
General
These Terms, together with our Privacy Policy, are the entire agreement between you and LawnSpotter about the Service. If any part of these Terms is found unenforceable, the rest remains in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce any part of these Terms is not a waiver.
